In Pennsylvania, the legal limit for blood alcohol concentration (BAC) is 0.08%. However, factors like heat, dehydration, and swimming can accelerate the effects of alcohol on your body, causing your BAC to spike faster than you’d expect.
Pennsylvania’s Tiered DUI System

It’s also crucial to remember that PA law allows for a DUI conviction even without a specific BAC reading if an officer proves you were "incapable of safe driving."
Checkpoints and Patrolling: Expect the Expected
The Pennsylvania State Police and local law enforcement heavily ramp up roving patrols and DUI checkpoints between Memorial Day and Labor Day.
If you are stopped at a checkpoint, you are required to provide your license, registration, and proof of insurance. While you must remain polite and cooperative, remember that you have rights. You have the right to remain silent regarding how much you’ve had to drink, and you have the right to refuse field sobriety tests (like walking in a straight line), though refusing a chemical breath or blood test at the station carries automatic license suspension consequences under PA's implied consent law.
