Pennsylvania’s Three-Tier Penalty Structure for a First DUI

Pennsylvania classifies first-offense DUI severity by blood alcohol concentration at the time of arrest. The tier your BAC falls into determines the criminal penalties a conviction would carry, and understanding those penalties is the starting point for understanding what’s at stake.

The three tiers for a first offense are:

General Impairment (0.08–0.099% BAC): Typically no mandatory jail time, up to six months probation, fines up to $300, and possible Alcohol Highway Safety School. Depending on the specific facts of your case and current Pennsylvania law, ignition interlock device installation may also be required.
High BAC (0.10–0.159% BAC): 48 hours to six months imprisonment, 12-month license suspension, fines between $500 and $5,000.
Highest BAC (0.16%+ BAC): 72 hours to six months imprisonment, 12-month license suspension, fines between $1,000 and $5,000.

A first-offense DUI is generally an ungraded misdemeanor in Pennsylvania. Certain aggravating factors can increase the severity of the charge. Having a passenger under 18 years old, for example, elevates a first offense to a first-degree misdemeanor carrying up to five years in jail and a $10,000 fine. Beyond the criminal penalties, a conviction creates a permanent record with real downstream consequences: employment background checks, housing applications, insurance rates, and professional licensing can all be affected.

ARD Eligibility & License Suspension Under the Program

Not every first-time defendant qualifies for ARD, and meeting the basic criteria doesn’t guarantee admission. To be eligible, you must be a first-time offender with no prior DUI conviction or ARD acceptance within the past 10 years, must have held a valid driver’s license at the time of the arrest, must not have had a passenger under 14 years old in the vehicle, and must not have caused serious injury or death in a connected accident.

One of ARD’s most significant benefits is a reduced license suspension. Compared to a conviction, the difference is substantial:

BAC under 0.10%: No license suspension under ARD
BAC 0.10–0.159%: 30-day suspension under ARD, versus 12 months at conviction
BAC 0.16%+ or chemical test refusal: 60-day suspension under ARD, versus 12 months at conviction

ARD also eliminates exposure to the mandatory minimum jail terms that attach to High and Highest BAC convictions. The program has requirements, and failure to meet them, such as missing required evaluations or classes, can result in removal and reinstatement of the original charges. The Dauphin County District Attorney retains discretion to deny ARD even to technically eligible applicants, which is why having an attorney advocate for your admission matters.
